Sigh… A guy named Jai Sen from New York has filed a class action lawsuit against Apple and AT&T alleging the following in a nutshell:
- The iPhone is prone to hairline cracks in the housing (I have never heard of this until today. But a quick search of Canadian Apple fanboi discussion site ehmac.ca turned up this thread that describes the a similar issue with the iPhone 3G)
- The power demands required by AT&T’s 3G network and AT&T’s struggle to respond to these issues.
- Misleading advertising by both parties.

The lawsuit is seeking restitution, damages, and disclosures and/or disclaimers to be added to packaging and advertisements for the iPhone 3G.
I have not heard as many fanbois iPhone users complaining about issues with the iPhone since the 2.1 firmware was released. So this lawsuit is a bit of a surprise. Perhaps not all the issues that users were experiencing were resolved? Or perhaps this guy is out to try and make a quick buck?
