Woman Sues Rogers For Outing Her Affair…. WTF? [UPDATED x3]
This has got to be be one of the weirdest things that I’ve read in a long time.
Today’s Toronto Star is reporting that Rogers is being sued by a woman because the fact that their billing practices led to the discovery of her extra-marital affair. Here’s an excerpt from the Toronto Star story:
In 2007, Gabriella Nagy had a cellphone account with Rogers which sent the monthly bill to her home address in her maiden name. Her husband was the account holder for the family’s cable TV service at the same address. Around June 4, 2007, he called Rogers to add internet and home phone.
The following month, Rogers mailed a “global” invoice for all of its services to the matrimonial home that included an itemized bill for Nagy’s cellular service, according to the statement of claim filed in Ontario Superior Court of Justice.
When Nagy’s husband opened the Rogers invoice, he saw several hour-long phone calls to a single phone number.
“Nobody does business this way and he’s not stupid,” says Nagy, who is in her 30s. He called the number, spoke to the “third party” who confirmed the affair, which had lasted only a few weeks, Nagy told the Star.
She’s now suing Rogers for $600,000 for invasion of privacy and breach of contract. Oh yeah. Rogers ruined her life too. Now Rogers have been accused of many things, like altering web page content, and digging up driveways of non-customers, etc. But ruining people’s lives and outing their extra-marital affairs seems a bit much to me. Rogers will defend themselves of course and I hope they win.
Wait a second… Did I just say that I am cheering for Rogers to win?
Yes I did. That’s really bizarre given the fact that I can be very critical of that organization. So why am I doing that? The fact that her husband found out about the affair by looking at a consolidated Rogers bill is not Rogers fault in my mind. If she wanted to hide this affair, she might have used a pre-paid cell phone or taken other steps to cover her tracks. But she didn’t and now she’s embarrassed and her marriage is over. Sucks to be her. She needs to (to borrow a Dr. Phil phrase) “own that” and deal with it. But keep in mind that I’m a computer nerd, not a lawyer. Ultimately teams of lawyers will fight this out in court and we’ll see who wins.
I for one hopes that it’s Rogers.
UPDATE: The person at the center of this story contacted me via the comments section and left a link to her blog that offers a few more details that were not in the Toronto Star article. One interesting thing is that the blog claims that Rogers consolidated the billings “in error” and fixed that after it was brought to their attention. I’d love to get Rogers side of the story to see if that’s true or not, but I suspect that they’ll invoke the “we won’t comment because the case is before the courts” line. Even if that were true, I still have problems seeing how Rogers can be held liable for what’s happened to her. But again I’m a computer nerd, not a lawyer.
UPDATE #2: MobileSyrup.com is reporting that the husband (ex-husband?) is the one that initiated the process to have a “global” bill. This is getting very interesting.
UPDATE #3: I asked Rogers for a comment and to my surprise, they actually responded. Here’s what they said:
“We were informed that Ms Nagy and her husband wished to have all services consolidated onto a single bill when the couple called to add additional services to their account. We did not terminate Ms. Nagy’s contract or automatically consolidate these accounts.”

To this comment. I am the woman suing Rogers wireless. I have statements from the operations manager from rogers wireless when we had examinations and they clearly stated the at no time did they check with Ms. Nagy for approval, 2nd, the rogers lawyer states in black and white that e to him without any question, so how many husbands did they assume I had. They simply did not take the time to verifie over and over. have exahusted all searches for my actual contract, so they lost that too, third in 2009, the past reoccurs again where they transferred my services to my husbands account and that is when I went somewhere else. 3rd on the rogers print outs their evidance shows the third party calling in claiming to be my husband and requesting my password and sim card number and giving his name not my real husbands and g

She should remain as a widow the rest of her life. She should spare any other living man the pain of her straying character. She would do well to be used in one night stands and strip parties and other areas where amorous men use her for a night then forget her name after the session. She is definitely not wife material
