Montana Hit With Two Lawsuits Related To TikTok Ban

Remember the ban on TikTok that Montana brought into force? At the time I said this about TikTok:

They don’t want laws like this to spread like wildfire. Nor do they want the US government to do the same thing. My guess is that this is about to blow up as this is a crisis for the Chinese owned social media app.

Guess what? TikTok creators have sued Montana over this ban:

But that’s not all, TikTok has dropped a lawsuit on Montana:

Social media company TikTok Inc. filed a lawsuit Monday seeking to overturn Montana’s first-in-the-nation ban on the video sharing app, arguing the law is an unconstitutional violation of free speech rights and is based on “unfounded speculation” that the Chinese government could access users’ data.

The lawsuit by TikTok, owned by Chinese tech company ByteDance, follows one filed last week by five content creators. They made similar arguments including that the state of Montana has no authority to take action on matters of national security. Both lawsuits were filed in federal court in Missoula. 

And:

TikTok says it has not shared and would not share U.S. user data with the Chinese government and has taken measures to protect the privacy and security of its users, including storing all U.S. user data in the United States, according to the lawsuit.

So much as I predicted, this has blown up. Montana has a problem on its hands as it’s about to fight these lawsuits. And while I am not a lawyer, I wonder if Montana’s will survive these lawsuits. I guess we are about to find out.
