Psystar To Nail Apple With Countersuit….. Steve Readies The iLawyers….

Here’s a plot twist in the Apple vs. Psystar lawsuit. Psystar is going to sue Apple for anticompetitive business practices:

Miami-based Psystar, owned by Rudy Pedraza, will sue Apple under two federal laws designed to discourage monopolies and cartels, the Sherman Antitrust Act and the Clayton Antitrust Act, saying Apple’s tying of the Mac OS to Apple-labeled hardware is “an anticompetitive restrain of trade,” according to attorney Colby Springer of antitrust specialists Carr & Ferrell. Psystar is requesting that the court find Apple’s EULA void, and is asking for unspecified damages.”

I have to give Psystar credit for having balls of steel trying to fight Apple in the legal arena. But I can’t see it succeeding. Speaking of lawyers, you can bet the iLawyers are getting ready to defend Steve and company against this threat.

Are there any actual lawyers who care to comment on Psystar’s chances?

    I’m not a lawyer…but it seems to me that Apple can do what they want with their own property. They ARE unique, after all, in that they manufacture both the hardware and the operating systems and sell them as a package. There is no parallel to that in the Windows based market and there is no logical reason why they should HAVE to adopt that market structure. Microsoft could have gone that route but they made the choice to let someone else build the systems and they’d just supply the OS. As it turns out, that was the smarter business plan seeing as how they basically pwned all other OSs as far as market share.

    Sure it would be cool if Apple allowed computer manufacturer’s to license OS X and distribute it but that’s 100% Apple’s choice and if they don’t want to do it – it ain’t gonna happen.
