US Justice Department Sues Adobe Over Subscriptions

Adobe has had a few problems over the last week. Most notably the uproar over the changes in their terms of use of their apps. But they now have a new problem that they need to worry about. The US Justice Department is suing them:

The Justice Department, together with the Federal Trade Commission (FTC), today announced a civil enforcement action against Adobe Inc. and two Adobe executives, Maninder Sawhney and David Wadhwani, for alleged violations of the Restore Online Shoppers’ Confidence Act (ROSCA). The lawsuit alleges that the defendants imposed a hidden “Early Termination Fee” on millions of online subscribers and that Adobe forced subscribers to navigate a complex and challenging cancellation process designed to deter them from cancelling subscriptions they no longer wanted.

Adobe Inc. is a software company that offers online subscriptions to design and productivity software applications via its website, Adobe.com. David Wadhwani is Adobe’s President of Digital Media Business, and Maninder Sawhney is Adobe’s Vice President of Digital Go to Market & Sales.

According to a complaint filed in the U.S. District Court for the Northern District of California, the defendants have systematically violated ROSCA by using fine print and inconspicuous hyperlinks to hide important information about Adobe’s subscription plans, including about a hefty Early Termination Fee that customers may be charged when they cancel their subscriptions. The complaint alleges that for years, Adobe has profited from this hidden fee, misleading consumers about the true costs of a subscription and ambushing them with the fee when they try to cancel, wielding the fee as a powerful retention tool.

The complaint alleges that Adobe has further violated ROSCA by failing to provide consumers with a simple mechanism to cancel their recurring, online subscriptions. Instead, Adobe allegedly protects its subscription revenues by thwarting subscribers’ attempts to cancel, subjecting them to a convoluted and inefficient cancellation process filled with unnecessary steps, delays, unsolicited offers and warnings.

The lawsuit seeks unspecified amounts of consumer redress and monetary civil penalties from the defendants, as well as a permanent injunction to prohibit them from engaging in future violations.

I have heard stories about it being difficult to cancel Adobe subscriptions. I guess that this lawsuit confirms that. Which is bad news for Adobe. You have to wonder if this combined with their other issues will send customers to the exits. I’m sure Adobe will deny the charges and say they will fight this. But honestly, how many battles can one company fight at the same time?

Pressure Mounts On CISOs With Reporting Set To Rise By Up To 20x As SEC Bares Teeth With Legal Action

Panaseer, a leader in security posture management powered by Continuous Controls Monitoring (CCM), has released a blog analyzing the increased focus on cybersecurity posture in reports to the Securities and Exchange Commission (SEC). Panaseer warns this growth in reporting will place CISOs at real risk of legal action if their organizations’ statements do not match reality.

The Panaseer investigation into organizations’ annual 10-K filings reported to the SEC shows that, from January-May 2024, at least 1,327 filings mentioned ‘NIST’ (National Institute of Standards and Technology) – a key indicator that cybersecurity posture is present in a filing. This compares to just 110 during the same period of 2023 – a 12-fold increase – and 128 across the entire year. On current projections, Panaseer predicts up to 2,600 such filings across 2024 – a more than 20 times increase. 

This will put pressure on CISOs for two reasons: 

  1. The burden of additional cybersecurity reporting: December 2023’s new SEC rulings that incorporated cybersecurity risk into investor reporting mandated the inclusion of cybersecurity posture and processes in annual reports. Although CISOs won’t be directly responsible for compiling reports, they’ll need to work closely with the Enterprise Risk Management (ERM) team to ensure reports are accurate.
  2. The threat of legal action: Accurate reports demand a deep understanding of cybersecurity posture and risk exposure. Any discrepancies between reports and reality will be tantamount to lying to investors, leaving CISOs potentially facing charges. SolarWinds’s CISO, Timothy G. Brown, has already been charged by the SEC for fraud and internal control failures relating to allegedly known cybersecurity risks and vulnerabilities.  

The new regulation applies to listed enterprises, with two separate SEC reports that apply to cybersecurity:

  • A 10-K filing – a comprehensive annual report of critical information including financial performance. Now, organizations must detail their approach to cyber risk management, including cybersecurity strategy; board oversight; and management’s role in cyber governance.
  • An 8-K filing – a report announcing major events shareholders should know about. This now requires businesses to disclose “material cybersecurity incidents” – which are likely to impact investors – in a timely fashion. These must be reported within four days after the determination of materiality.

To satisfy the SEC, these filings need to accurately portray cybersecurity posture. The new rulings also reflect an ongoing shift in the CISO’s role. While not solely responsible for organizations’ risk posture, CISOs need to accurately portray risk posture and security processes to the ERM team and the board. CISOs need to understand and communicate their company’s cybersecurity practices clearly, with a data-driven approach that enables factual filings.

As such, Panaseer recommends that CISOs direct their focus towards ensuring that there’s oversight and assurance over the security tool they have, verifying that they are working correctly across every asset.

New Software Vulnerability Ratings Report For 2024 Finds High Exploitability Rates & RCE Vulnerabilities

Action1 has unveiled new research in its Software Vulnerability Ratings Report 2024 to provide trends based on exploitability rates and the dynamics of Remote Code Execution (RCE) vulnerabilities within enterprise software categories and specific applications. Key findings include:

  • Attackers target load balancers with record exploitation rate: Action1 researchers discovered a high exploitation rate for NGINX (100%) and Citrix (57%). Vulnerabilities in load balancers pose significant risks, as just one exploit can provide attackers with broad access or disruption capabilities against targeted networks. 
  • Threat actors target Apple operating systems: MacOS and iOS showed an increased exploitation rate of 7% and 8%, respectively. Additionally, although MacOS reduced its total vulnerability by 29% from 2023 to 2022, exploited vulnerabilities increased by over 30%. These findings underscore the targeted nature of attacks on iOS devices.
  • MSSQL RCE vulnerabilities surge, highlighting the risk of new exploits: In 2023, Microsoft SQL Server (MSSQL) experienced a 1600% surge in critical vulnerabilities, each being an RCE. This spike signals a potential risk that attackers are quickly discovering and exploiting the next unknown RCE.
  • Increased exploitability of MS Office as attackers take advantage of human error: MS Office’s critical vulnerabilities account for nearly 80% of the overall annual vulnerability count, up to 50% being RCEs. In 2023, Microsoft saw its exploitation rate rise to 7%, compared to 2% in 2022. These findings underscore threat actors’ exploitation of user-facing software prone to human error

To address this, StorageMAP 7.0 includes two new features that help companies drive critical decision making about their unstructured data: Custom Dashboards and an Analysis Module.

  • Custom Dashboards enable the entire range of stakeholders to create a library of views of their unstructured data that is relevant and specific to them. Custom Dashboards use metadata fields and StorageMAP tags to visualize, organize, and monitor the data in a single pane of glass. A Custom Dashboard has a number of key elements that can be added by the user including point in time charts, series charts, and lists among others.

Data shown on a Custom Dashboard can be categorized according to, for example, data ownership, age, last accessed time or any user defined tags such as data criticality, sensitivity, usefulness, and so on. Additionally, Custom Dashboards can be exported in MS PowerPoint® format to easily share with all stakeholders.

  • The Analysis Module is the place to explore and analyze trends in an enterprise’s unstructured data and can also be customized to specific user needs. An analysis can consist of multiple layers of filters and classifications that create datasets matching the criteria of interest. The resulting datasets can then be used to create charts, tabular output, and other reports. The results can be included in Custom Reporting Dashboards and used as input for actions such as migration, replication, pipelining etc. all carried out within StorageMAP.

Data Mobility Enhancement

With StorageMAP 7.0, Datadobi continues to far outpace all competition by continuously adding new functionality to its unequaled armory of complex data mobility solutions. DMZ Insiders awards $250,000 CAD in funding to high-potential startups

Toronto Metropolitan University’s DMZ held its highly anticipated Insiders Event at the global startup ecosystem’s headquarters in downtown Toronto. This exclusive showcase featured a selection of the most innovative high-potential early-stage startups from DMZ’s portfolio, offering attendees the chance to witness transformative solutions across various industries.

The eight participating startups pitched their tech solutions to an invite-only gathering of esteemed investors, corporate leaders, and DMZ’s global partners, with the goal of securing investment from DMZ Ventures’ newly launched corporate fund.

The investment fund, managed by the for-profit arm of DMZ at Toronto Metropolitan University, DMZ Ventures, will make up to 10 investments per year, ranging from $100,000 to $250,000 CAD. The fund will support promising pre-seed and seed-stage startups, primarily from DMZ’s portfolio, and is strongly committed to backing underserved founders.

Roku & McDonald’s Partnership Will Make It Easier To Order-In While You Stream-On

Today, Roku and McDonald’s announced that McDonald’s will become Roku City’s first exclusive tenant in Canada later this year. Starting now and continuing to evolve throughout the year, this TV streaming campaign leverages a holistic approach that has been successful across other markets globally and makes McDonald’s the first delivery partner featured in Roku City with a branded building in 2024. This collaboration makes McDonald’s the first Quick Service Restaurant (QSR) to take advantage of new first-to-market action ads and high-impact units within the Roku platform in Canada.

The New Nikon Z6III Outperforms Expectations

Today Nikon Canada Inc. announced the Z6III, a 24.5MP full-frame mirrorless camera that stands in a class of its own with an unmatched suite of powerful features that bring exceptional performance to both photographers and filmmakers. The Z6III is the world’s first camera with a partially-stacked CMOS sensor, delivering ultra-fast readout that unlocks blistering speeds and high frame rates in both photo and video modes. Other benefits include a truly immersive viewfinder experience with the brightest EVF of any mirrorless camera, and a wide range of pro-level features inherited from Nikon’s acclaimed Z8 and Z9 flagship cameras. 

The combination of the Z6III’s unique new sensor design and EXPEED 7 image processing engine results in an approximately 3.5x increase to readout speed compared to the previous-generation Z6II. This unlocks enhanced performance across the board, enabling benefits such as 6K internal N-RAW and ProRes RAW video, Full HD video up to 240p, and rapid continuous shooting of stills up to 120 fps with Pre-Release Capture. However, the camera’s incredible performance goes far beyond just frame rates. The Z6III features an impressively fast AF system inherited from the Z8 and Z9, which includes highly advanced multi-subject detection with the speed and accuracy needed for maximum confidence.

OUTPERFORM WITH UNMATCHED FEATURES

World’s first partially-stacked sensor: The Z6III is the first mirrorless camera to adopt this new sensor architecture, which features multiple high-speed processing circuits stacked in layers above and below the imaging area of the sensor. The high-speed readout made possible by this new sensor in combination with the same EXPEED 7 processing engine as the Z8 and Z9 enables a range of powerful features. 

Upgraded autofocus: AF is fast and accurate, clocking in at a full 20 per cent faster than the Z6II.  In challenging light, the AF detection range has been extended to an incredible −10 EV, superior even to the flagship level cameras. This enhanced sensitivity makes it easier to focus in dark situations like nighttime sports or an event reception. 

Advanced subject detection: The Z6III draws on the advanced subject-detection technology of the Z8 and Z9 to automatically detect nine subject types, including people, animals and various vehicles. Users can lock onto these subjects with advanced AF modes including 3D-tracking, Auto-area AF, Wide-area AF and Dynamic-area AF. Custom wide-area AF patterns allow for the detection and tracking of subjects within a custom designated area. 

Pre-Release Capture up to 120 fps: This powerful feature enables photographers to capture shots that might have otherwise been missed, such as the moment a bird takes flight, a lightning strike or the game-winning goal. A half-press of the shutter-release button starts buffering images, and when the shutter is pressed all the way, the Z6III saves images taken up to one second prior. 

Internal 6K RAW video: The Z6III is capable of capturing 12-bit 6K/60p N-RAW and 6K/30p ProRes RAW, as well as 10-bit 5.4K ProRes 422 and H.265 video formats. The ability to capture super high-resolution video footage affords filmmakers the freedom to crop, trim, track and stabilize a 4K timeline in post with ultimate clarity. Furthermore, filmmakers can take advantage of the Z6III’s maximum video resolution of 6K to create oversampled 4K UHD/60p video footage. The Z6III’s efficient heat-dissipating design allows continuous 4K UHD/60p recording for up to 125 min.

Brightest EVF of any mirrorless camera: At up to 4,000 cd/m2 (nits), the Z6III’s 5,760k-dot electronic viewfinder is the brightest ever in a mirrorless camera, delivering a clear, detailed view even in extremely bright outdoor situations while minimizing viewfinder blackout. In addition to its class-leading brightness and high resolution, the Z6III’s EVF is the first in a mirrorless camera to support a DCI-P3 equivalent colour gamut, which enables photographers and filmmakers to see a more lifelike display of colours.

Dynamic Full HD/240p slow motion: The Z6III can capture dramatic slow-motion footage up to 10× with 10-bit Full HD/240p H.265 video recording.

Amazing low-light ability: The Z6III’s wide native ISO range is from 100-64,000 (51,200 in video) and is expandable to 204,800 for ultra-low-light shooting. The Z6III’s EXPEED 7 image processing engine enables tailored noise reduction, effectively minimizing grainy noise in flat areas of the image while preserving fine details in subjects such as buildings. This results in sharper, clearer images in low-light environments.

8.0 stop Vibration Reduction: Built-in 5-axis image stabilization delivers up to 8.0 stops of Vibration Reduction, empowering photographers and filmmakers to shoot handheld with confidence. Enjoy the creative freedom of slower shutter speeds, while keeping subjects sharp and using lower ISOs. Additionally, the Z6III features Focus Point VR, which prioritizes stabilization on the active focus point. 

Vari-angle LCD screen: The 3.2-inch rear LCD touchscreen can be used as a front-facing screen for video production and self-recording, as well as framing at a low angle.

High-resolution Pixel Shift mode: In Pixel-shift mode, the Z6III’s sensor is subtly shifted across 4, 8, 16, or 32 exposures, for increased colour and detail with an incredibly high resolution of up to approximately 96MP.

Z8-level build quality: The Z6III is constructed from magnesium alloy and Sereebo® material for maximum durability and light weight. Weighing only 1.67 lbs. with a battery and memory card, the Z6III is sealed against dust and moisture to the same level as the Z8, and is rated for operation down to 14°F/−10°C, making it suitable for use in a wide variety of environments and conditions.

Flexible Colour Picture Controls: The Z6III supports the new Flexible Colour Picture Control feature in NX Studio. Z6III owners can use the software’s powerful Colour Blender and Colour Grading features to create custom presets that can be uploaded to the camera as Custom Picture Controls.

NEW NIKON IMAGING CLOUD 

Nikon Imaging Cloud will be a new complimentary cloud service that expands connectivity and creative options for Z6III owners. Users will be able to browse a suite of curated Imaging Recipes courtesy of Nikon and selected creators, which provide all the ingredients necessary to create amazing images: Suggested camera settings, inspiring insights plus Cloud Picture Control presets that Z6III owners can download straight to their camera. Furthermore, when the Z6III is connected to Nikon Imaging Cloud via Wi-Fi, still images captured with the camera can be automatically uploaded to a range of popular cloud storage services including NIKON IMAGE SPACE, making the storage and sharing of images even more convenient. Nearly 500K images belonging to Total Fitness, a UK based chain of health clubs were leaked according to cybersecurity researcher Jeremiah Fowler. 

The key findings are as follows:

  • 474,651 images with a total size of 47.7 GB;
  • Facial images of gym employees, members, and children, some of them taken in the facilities during the membership process;
  • Some of the most concerning images uploaded by users contained highly sensitive information, including passports, credit cards, and utility bills

If this data was discovered by ill-intentioned hackers, it could have put members at risk of identity theft, financial fraud, and many other online threats.
