Epic V Apple Will Go To A Jury…. Though That May Not Go Well For Epic

Epic V Apple has yet another plot twist in it. A judge has heard each company’s cases before making initial rulings and trial dates. And this happened:

A federal judge in California on Monday urged Apple Inc and “Fortnite” creator Epic Games to take their antitrust dispute before a jury, saying the higher courts would be less likely to overturn the result.

“I know I’m just a stepping stone for all of you,” District Judge Yvonne Gonzalez Rogers said during a virtual hearing from Oakland, California.

Any trial wouldn’t happen until next July according to AppleInsider. That may not go well for Epic as a jury may be less favorable to their arguments. Then there’s the fact that the judge overseeing this hearing wasn’t exactly receptive to Epic’s arguments:

The judge repeatedly highlighted that the matter was of Epic’s own doing, at times when Epic’s lawyers urged there was harm. Epic forced Apple’s hand in the matter, and it also has the opportunity to agree to Apple’s rules for “Fortnite” to be readmitted to the App Store. 

There was also some pushback on Epic’s repeated declarations that Apple was a monopolist, as well as Epic’s disregarding of rules and not being “forthright” with Apple itself. The judge also highlights the oddity of Epic’s arguments against Apple comparing a smartphone to a game console due to size reasons, by referencing the existence of the Nintendo Switch.

This perhaps would be a really good time for Epic to reconsider their position. While things can change, and it’s early days in this process, it doesn’t look promising for Epic. And maybe they want to think about taking this in a very different direction.

Salesforce Releases The Small and Medium Business Trends Report

Fun fact: 97.9 per cent of all businesses in Canada are SMBs, and these companies in particular have had to demonstrate exceptional resilience as they adapt to a spectrum of unforeseen challenges during the pandemic.

Today, Salesforce has released the fourth edition of their “Small and Medium Business Trends Report,” analyzing the responses of more than 2,300 SMB owners and leaders (including 251 Canadians) before and after the pandemic took hold around the world.

The report determines:

  • How multiple global crises (pandemic, economic, and racial injustices) affect their changing motivations, challenges, and goals
  • The role of digital transformation in driving small business resiliency
  • How SMB leaders are planning for recovery and growth in a post-COVID-19 era

Impact of COVID-19 pandemic on Canadian SMBs:

  • Expectations for Canadian Businesses After COVID-19: 
  • Only one-third of Canadian SMBs expect to return to business as usual 
  • Half of Canadian SMBs say their business will be slightly modified 
  • 1 in 10 Canadian SMBs say their business will have an entirely new structure

Top 3 Factors Constraining Future SMB Growth Due to the COVID-19 Pandemic:

  • Reduced revenue (46%)
  • Reduced customer demand (43%)
  • Public health mandates (40%)

SMB resilience and optimism persist, even amidst new challenges:

  • A quarter (26%) of Canadian SMBs say they are very optimistic about the future (compared to 22% globally) and almost half (47%) of Canadian SMBs say they are somewhat optimistic about the future of their businesses.
  • Half (48%) of Canadian SMBs are putting more effort into their customer communications and expanding the ways customers can reach them


Digital-forward SMBs are more equipped to handle market volatility:

  • Over a quarter (28%) of Canadian SMBs have adopted technology to help digitize customer interactions and offer contactless services.
  • A third (31%) of Canadian SMBs have adopted technology to help digitize internal communications, so employees can collaborate or access info from anywhere
  • Almost half (46%) of Canadian SMBs say technology drives their customer interactions, and 4 in 10 (42%) of Canadian SMBs say it drives the growth of their customer base

OVHcloud Start-up Program Opens Up To Scaleups For Its 2020 Edition

Launched in 2015, OVHcloud’s Start-up Program has already supported more than 1,800 young companies around the world, including 250 in North America, through an investment of more than €6 million in infrastructure credits and development support. To mark the start of the new fiscal year, OVHcloud is reaffirming its commitment to supporting young companies that put cloud infrastructure at the heart of their business model.

Dedicated support for start-ups and scaleups

In order to support start-ups and scaleups putting the cloud at the heart of their business model in their development, OVHcloud has designed a 12-month program adapted and proportionate to the needs of each. The program includes: 

  • A grant of up to $15,000 CAD to be used on OVHcloud products for start-ups and up to $150,000 CAD for scaleups.
  • Personalized support from 6 hours for start-ups and up to 20 hours for scaleups.
  • A dedicated community space to exploit the potential of the OVHcloud ecosystem.
  • Access to the Open Trusted Cloud program; from the 1st day for scaleups and at the end of the 12-month program for start-ups.
  • Exposure through joint communications with OVHcloud, booths at international trade shows, speaking opportunities during OVHcloud events, workshops and conferences dedicated to start-ups (online and offline) as well as joint use cases published on the OVHcloud website.
  • Start-ups with the fastest developments can of course upgrade to the level of support dedicated to scaleups during the program. 

A first springboard to success

Behind this program, the objective is obviously to see the start-up or scaleup develop according to the choices of its own teams. This is why the OVHcloud Start-up Program follows the same rules as the rest of the company and applies its conception of a SMART cloud (Simple to use, Multi-local, Accessible, Reversible and Transparent). OVHcloud’s open technology is made available to companies participating in the program to accelerate their business and growth with no strings attached.

OVHcloud does not take a share of the start-up’s capital, nor does it require the start-up to use its infrastructure at the end of the 12 months of the support program. OVHcloud acts first and foremost as a facilitator, putting start-ups in contact with what they need most (IP and financing experts, incubators, venture capital firms, etc.) and providing the infrastructure on which their business model is based. This non-binding model guarantees each start-up the reversibility, interoperability and control of its data.

At the end of the program, the organizations participating in the program will be able to continue using OVHcloud infrastructures or not, but also to integrate the Open Trusted Cloud, its trusted ecosystem of SaaS and PaaS services.

Dell has new XPS laptops that are launching soon and will be the first Intel® EVO™ platform-based Dell systems powered by 11th Gen Intel® Core™ processors. Specifically new XPS 13 and XPS 13 2-in-1 models which  were briefly featured onstage during Intel’s recent Tiger Lake launch event.

New features on XPS 13 2-in-1:

  • 11th Gen Intel® Core™ processors and Xe graphics
  • Thunderbolt 4 
  • Memory update to 4267MHz LPDDR4x (From 3733MHz)
  • IR camera with Windows Hello capability
  • Updated design ID — machined aluminum in platinum silver with black carbon fiber or frost with arctic white woven glass fiber palm rest (previously available in platinum silver and arctic white)
